Man with Van Freezywater Terms and Conditions

These Terms and Conditions set out the basis on which Man with Van Freezywater provides man and van, moving, transport and related services within the United Kingdom. By making a booking, using our services or allowing our staff to carry out any work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming your booking.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business or organisation who requests and uses our services.

Company means Man with Van Freezywater, providing man and van and removal services.

Services means any transport, removal, loading, unloading, packing, moving, delivery, or related services supplied by the Company.

Goods means any items, belongings, furniture, equipment, or property transported or handled by the Company as part of the Services.

Vehicle means any van or other vehicle used by the Company for the provision of the Services.

Booking means an agreed arrangement for the Company to provide Services on a specified date and time, whether agreed verbally, online or in writing.

Service Scope

The Company provides man and van and removal services for domestic and commercial customers, including but not limited to household moves, small office moves, student moves, furniture transport, and general light removals. The exact scope of each job, including the type of vehicle, number of staff, estimated duration and route, will be agreed at the time of Booking.

Any additional services requested on the day that were not specified at the time of Booking, such as extra stops, additional floors, packing assistance or waiting time, may incur additional charges and are subject to availability of time, staff and vehicle capacity.

Booking Process

Bookings can be made by contacting the Company and providing full and accurate information regarding the move or transport required. The Customer is responsible for providing correct details, including collection and delivery addresses, access information, parking arrangements, the nature and approximate volume of Goods, and any special handling requirements.

All Bookings are subject to availability and are not confirmed until the Company has accepted the Booking and provided a confirmation. The Company reserves the right to refuse any Booking without giving a reason.

The Customer must inform the Company of any changes to the Booking details as soon as reasonably possible. The Company will use reasonable efforts to accommodate changes, but cannot guarantee availability or that original prices will be maintained if the scope or timing of the job changes.

Quotations and Pricing

Any quotation provided by the Company is based on the information supplied by the Customer at the time of enquiry. Quotations may be given as a fixed price, an estimated price, or an hourly rate, and will be clearly identified as such.

If the information provided by the Customer is incomplete or inaccurate, the Company reserves the right to revise the quotation or charge for additional time, distance, staff or services. Reasons for additional charges may include, without limitation, extra items not disclosed, poor access, unexpected flights of stairs, waiting time, extra loading or unloading points, or delays caused by the Customer.

Quotations are valid for a limited period as advised by the Company and may be subject to change due to fluctuations in fuel costs, congestion charges, tolls or other external factors.

Payments and Charges

The Customer agrees to pay the Company the agreed charges for the Services, together with any additional charges properly incurred in accordance with these Terms and Conditions. Unless otherwise stated, charges are exclusive of any applicable taxes or government charges.

Payment terms will be communicated at the time of Booking. The Company may require a deposit to secure a Booking, with the balance payable before or upon completion of the job. For hourly rate jobs, the chargeable time usually starts when the Vehicle and staff arrive at the collection address and ends when unloading is completed at the final destination, subject to any minimum charge period.

The Company accepts payment by methods as advised at the time of Booking. All payments must be made in full and cleared funds by the due date. The Company reserves the right to refuse to start or continue a job if payment terms are not met.

If payment is not made when due, the Company may charge interest on overdue amounts, apply reasonable administration fees for chasing payment, and may withhold delivery or retention of Goods until full payment is received, to the extent permitted by law.

Customer Responsibilities

The Customer is responsible for:

Ensuring that they, or an authorised representative, are present at the agreed times at collection and delivery addresses.

Arranging suitable parking for the Vehicle at all addresses, including obtaining any permits or permissions required. Any parking charges, fines or penalties incurred due to inadequate provision or restrictions may be charged to the Customer.

Ensuring that access to the property is safe, clear and suitable for the Vehicle and staff, including stairs, lifts, corridors, entrances and exits.

Properly packing and securing Goods in suitable containers where the Company has not been contracted to provide packing services. Fragile or valuable items must be appropriately protected and clearly labelled.

Complying with all relevant laws and regulations in connection with the Goods and the Services, including waste regulations.

Items Not Accepted for Transport

The Company will not carry, and the Customer must not present for removal or transport, any of the following items:

Hazardous, dangerous, explosive, corrosive, flammable or toxic substances, including gas cylinders, fuels and chemicals.

Illegal goods, stolen goods, contraband, or any items the possession or transport of which is prohibited by law.

Perishable goods that may deteriorate during transit, unless previously agreed in writing.

Animals or live creatures of any kind.

Cash, jewellery, precious metals, securities, or items of exceptional value, unless specifically agreed and declared in advance, and subject to additional conditions or charges.

If such items are transported without the Company's knowledge or consent, the Company shall have no responsibility for loss, damage, or delay in relation to those items, and the Customer shall indemnify the Company against any resulting claims, damages or expenses.

Cancellations and Amendments

The Customer may cancel or amend a Booking by giving the Company as much notice as possible. Cancellation terms, including any applicable charges, will be communicated at the time of Booking and may depend on the notice period and the nature of the job.

The Company reserves the right to charge a cancellation fee where a Booking is cancelled at short notice, particularly if the Vehicle and staff have already been dispatched or reserved exclusively for the Customer. Cancellation on the day of the job may be charged up to the full quoted amount.

If the Customer is not present, or access is not possible at the agreed collection time and address, the Company may treat the job as cancelled and charge a cancellation fee or waiting time, at its discretion.

The Company may cancel or reschedule a Booking if it is unable to provide the Services due to circumstances beyond its reasonable control, including but not limited to severe weather, road closures, vehicle breakdown, staff illness or safety concerns. In such cases, the Company will seek to notify the Customer as soon as practicable and will offer to reschedule or refund any deposit paid, but shall not be liable for any consequential loss or expenses.

Delays and Waiting Time

The Company will use reasonable efforts to arrive at the agreed time, but all arrival and delivery times are estimates and cannot be guaranteed due to traffic, road conditions and other factors beyond the Company’s control. The Company shall not be liable for any loss or expenses arising from delays, unless caused by its own negligence.

Where significant waiting time occurs as a result of the Customer’s actions or circumstances, including but not limited to failure to provide access, incomplete packing, or delays in obtaining keys, the Company may charge additional waiting time at the agreed hourly rate or as otherwise advised.

Liability and Limitations

The Company will exercise reasonable care and skill in handling and transporting the Customer’s Goods. However, the Company’s liability for loss of or damage to Goods, or for delay, shall be limited as follows unless otherwise agreed in writing:

The Company will not be liable for loss or damage arising from inherent defects, poor packing by the Customer, normal wear and tear, or the fragile nature of certain items, including glass, mirrors, electronics or flat-pack furniture, unless damage is clearly caused by the Company’s negligence.

The Company will not be liable for any indirect or consequential loss, including loss of profit, loss of opportunity, or emotional distress arising from delays, damage or loss of Goods.

If the Company is found liable for loss or damage, liability may be limited to a reasonable cost of repair or replacement, taking into account the age, condition and current value of the item, and subject to any overall limits notified by the Company.

The Customer must inspect Goods as soon as reasonably possible upon completion of the job and promptly notify the Company of any apparent loss or damage. Any claims must be made within a reasonable period after completion of the Services, and in any event no later than 7 days, unless otherwise required by law.

Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be excluded under applicable law.

Insurance

The Company maintains appropriate insurance cover to support the provision of man and van and removal services, as required by law and good practice. This may include, for example, motor insurance and goods in transit cover, subject to policy terms, conditions and exclusions.

The Customer is encouraged to arrange their own additional insurance for Goods, particularly for high value or fragile items, to ensure adequate protection during moving and transport.

Waste Regulations and Disposal

The Company operates in accordance with UK waste and environmental regulations. Where the Customer requests collection and disposal of unwanted items, furniture, or household effects, this will be treated as a separate waste or clearance service and agreed in advance.

The Customer must not present for disposal any hazardous, clinical, liquid or restricted waste, including but not limited to asbestos, chemicals, paints, oils, gas bottles, or electrical items requiring special handling, unless the Company has expressly agreed and is properly licensed to do so.

All waste or unwanted items collected for disposal will be taken only to authorised facilities or transfer stations. The Customer remains responsible for ensuring that any waste provided for collection is lawfully theirs to dispose of and that no prohibited materials are included. The Customer will indemnify the Company for any liability, fines or costs arising from non-compliant waste supplied by the Customer.

Health and Safety

The Company is committed to maintaining safe working practices. The Customer agrees to provide a safe working environment for the Company’s staff and not to request any work that could reasonably be considered unsafe, including lifting excessively heavy items without suitable equipment, working at dangerous heights, or moving Goods through clearly unsafe routes.

The Company may refuse to carry out any task that it reasonably believes would put staff, third parties, property or Goods at undue risk. In such circumstances, the Company will discuss alternative options with the Customer where possible. If the Customer insists on unsafe practices, the Company may withdraw from the job and treat it as a cancellation by the Customer.

Complaints and Dispute Resolution

The Company aims to provide a professional and reliable service at all times. If the Customer has any concerns or complaints about the Services, these should be raised with the Company as soon as possible so that the matter can be investigated and, where appropriate, resolved.

The Customer should provide details of the complaint, including dates, addresses, a description of the issue, and any supporting information. The Company will review the complaint and respond within a reasonable time. Where a resolution cannot be reached informally, the parties may consider alternative dispute resolution methods as permitted by law.

Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure is due to events beyond its reasonable control, including but not limited to extreme weather, natural disasters, civil unrest, strikes, road closures, accidents, or interruptions to utilities. In such circumstances, the Company may suspend or reschedule the Services and will use reasonable efforts to minimise disruption.

Privacy and Data Protection

The Company may collect and process personal data from the Customer for the purposes of handling enquiries, managing Bookings, providing Services, processing payments and meeting legal obligations. The Company will treat personal data with appropriate care and will not sell Customer details to third parties.

By making a Booking, the Customer consents to the use of their personal information for these purposes. The Customer has rights under data protection law to access and, where appropriate, request correction of their personal data held by the Company.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, save where applicable law permits a consumer to bring proceedings in the courts of their own jurisdiction.

Variations and Entire Agreement

The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s Booking will apply to that Booking. Any changes will normally take effect for future Bookings only.

These Terms and Conditions, together with any specific terms agreed in writing relating to a particular Booking, constitute the entire agreement between the Customer and the Company in relation to the Services. No verbal statement or representation by any representative of the Company shall be binding unless confirmed in writing.

Severability

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, consistent with the parties’ original intent.

Acceptance of Terms

By placing a Booking with Man with Van Freezywater, the Customer confirms that they have read, understood and agree to these Terms and Conditions. If the Customer does not agree, they must not proceed with the Booking or use the Services.
